Re: The Internet Archive |
I really Dont know any more than anyone else here! The Google thing is only a guess at whats going on. If you look Back in the older posts we have rarely had interaction with the IA staff. We had Sir Ken and he kept everything moving and the folks mostly happy. Miss Diana has stepped in a few times over the years, In her last post she said moving would stop awaiting "Regular IA Staff" input. Sounds like she wasnt getting answers either??? I dont know if anyone other than Ken was in charge of Moving items for us. I only have limited permissions that extend here and in the OTR group. The other Mods seem to only work at the LMA.
Miss Alexis left a year and a half ago and I am not sure who if anyone took over as Collections manager. I think it is highly important Things get moved to their intended collection if just to make things easier to find. Its better to search a collection of 1500+ items as opposed to opensource with tens of thousands. Hopefully IA will figure this out soon.

Very Good Point Miss Jane, I looked at a few and they have 1500+ downloads in the week they have been here. These are Being actively promoted as links to get that many downloaders.
This isnt good. A very brief search brought me here
http://www.dardarkom.com/I think this is where some of the movies are being downloaded from.

Re: The Internet Archive |
Looks like one of those uploaders is "disguising" the files to get them in. Last I heard, changing the title doesn't make a piece of film pd. The infringement looks intentional and this is something we should ALL watch out for. If you catch it you should report it immediately as this could potentially get the site shut down. Staff should be especially vigilant and should act quickly when this is reported to them. Good eye, Jungle Jane.

Re: more copyrighted stuff |
Are these people stupid or just crazy? Most of what I saw were brand new movies, some of which I don't believe are even out on DVD yet! No way do these belong here and anyone with half a brain knows it! This is outright illegal and I'm pretty sure that the uploaders are aware of it. This will get the site shut down for sure if staff doesn't take action pronto.

I sent an Email to the "info at archive dot org" address this morning pointing all this out and that the simple solution would be to appoint a moderator for moving images.
Somehow I have little faith it will do any good but I've made my attempt to warn them.

Let us know if you get any response. I was going to do the same thing when I got a chance and I still might. What was shown is probably only the tip of the iceberg. I saw a lot of this sort of stuff going on at DivX.com's Stage6, and it got shut down a year or two ago. There was a lot of copyright material up for grabs at that site, some being recent movies (at the time) with their titles changed, but the disguise was weak. I'm sure that's what caused the shutdown. I'd hate to see the same thing happen here.

Still more copyrighted stuff |
I've checked the "this just in" box in Open Source a couple of times in the last hour and I keep finding even more copyrighted material. "90210"? "Texas Chainsaw Massacre"? Come on! No way is this stuff PD.

A lot of people have no respect for copyrights, that much is clear, and when it is brought to their attention, they either act dumb or get angry. Many people feel entitled to getting something for nothing, and proceed accordingly.

I'll give them some more time before I start drawing conclusions.

Re: Still more copyrighted stuff |
I noticed this person had uploaded an episode of the Showtime TV series "Dexter", being Viacom I am surprised they haven't already contacted this site but if the people who run this site have "vanished".well....
The subject of uploading copyright material...I am surprised the big guys ( Viacom, Dick Clark, Disney, NBC etc...) doesn't follow the footsteps of Baltimore's WBFF-TV when it comes to uploaded copyright material. What WBFF does when their stuff pops up on You Tube, not only do they contact You Tube BUT they also contact the person who did the actual uploading of the clip with a warning telling them the next time..the fines will come out of THEIR pocketbook. Now whehter or not WBFF will actually sue, i don't know but the scare alone will make many people to think twice.

The Archive is also on Symantec's list of unsafe sites
because there are a couple of nasty programs attached to
some items.
When the admin doesn't pay attention to what's going on
it really can get nasty in a hurry.
I wonder if someone at EFF knows how to get hold of
Brewster to give him a heads up on this stuff.

Re: Still more copyrighted stuff |
Hiya Sir John, Isnt that policy aimed more at websites/pages/content? Shouldn't IA also follow their own TOS policy as well?
"Copyright Policy
10 March 2001
The Internet Archive respects the intellectual property rights and other proprietary rights of others. The Internet Archive may, in appropriate circumstances and at its discretion, remove certain content or disable access to content that appears to infringe the copyright or other intellectual property rights of others."
OR its FAQ
"How can I add my music, movies, or text?
You may contribute content to the Internet Archive if it's in the public domain or if you own the rights to it."
What you seem to be saying is that as long as Viacom hasnt noticed this yet is ok to be here? Some of these 2009 Movies have garnered 2000+ downloads in the past ten days. I do not understand the thought process that allows this blatant piracy to run unchecked on this site now. I am certain neither streamfreak.org or dardarkom.com owns any rights to the movies/tv episodes they are uploading here.

Re: Still more copyrighted stuff |
I read the link.
As far as one claiming copyright and getting something removed..one thing this a lot of people either overlook or simply don't know is that in some cases "gentlemen's agreement" applies. Not sure if its the case with the big guys ( example Disney getting Warner Brothers stuff taken off ) but in some local TV markets it is the case.
Some months back I was considering about uploading a film on this site of KFEL-TV ( KWGN ) Denver's channel 2 first broadcast. After checking out some other sites, I discovered that some years back this "gentlemens agreement" was in effect in the Denver TV market. In other words had I uploaded that clip not only could KWGN demand the clip be taken down but so could the other TV stations in Denver, even those who have nothing to do with KWGN ( the former KFEL )..and living in Virginia I have better things to do with my time than calling up every TV station in Denver and asking for permission to upload a 10 minute clip. It wouldn't have been worth it.

Looks like someone woke up and the offending item have been taken down.
Now if only we could get a moderator.
I'm now expecting to get a bunch of hate mail from the usual suspects who get upset every time a copyrighted movie gets taken off IA.
edit: after posting this I went and checked and there are already new copyrighted movies showing up in open source. posted by one of the ones who just had a bunch of his stuff taken down.

There's some hard headed poeple in this world, that's for sure. Notice how he changed the way he uploaded them? I didn't check but I'd bet it's the same stuff that got taken down once already. Anybody know if I'm right on that?

I'm not sure. This looks like a batch of several movies or a anthology. None of them look familiar to me from the thumbnails so I can't compare them to his other uploads.

http://www.archive.org/details/streamjunkieThe films at this link are Godzilla (w/Matthew Broderick), Urban Legends: Bloody Mary, Urban Legends: Final Cut, and One-Eyed Monster. All are fairly recent theatrical or major studio films, and certainly not in the public domain.
I think Sony Pictures, Columbia, and Tri-Star among others would like to know...

Yes, Germany has copyright laws too but they are a lot different than U.S. copyright laws. You'd have to read them pretty carefully.

Re: The Internet Archive |
I guess nothing short of a nuclear war will stop these guys.
dar & yassine007 are back to uploading more copyrighted stuff and I've run across a new uploader to add to the list who's moniker is "en". I'm sure there's more there that I don't see since I'm just scanning through there and not really looking all that hard.
So what I get from this is no matter how egregiously you violate IA policies you wont get banned. The only way to deter these guy's is to have a moderator who will shut these file down almost as fast as these guys can upload them thus making it a waste of their time.
BUT since the IA wont bother with appointing a moderator the message I get from all this is, go ahead and upload whatever you want their not going to take it down unless someone rubs their noses in it.
And no I don't buy the argument that the people at IA are so busy with the google stuff that they don't have time for this. I don't know what their problem is but it sure is disheartening.

I streamed one that I found, brought to you by another of the friendly folks at dardarkom. I saw what looks like Arabic writing, maybe subtitles, on the picture. Do you think it might be an al qaeda plot to bomb the Archive with copyright material while the defences are down? Oh, and the picture quality of these is crap.

Banning doesnt work here. You can just get a new name with a new email addy and there they go again. This subject has come up before. I think these involve webpages on Wayback but I assume that it is the same for our problem.
http://www.archive.org/iathreads/post-view.php?id=221506http://www.archive.org/iathreads/post-view.php?id=221501I have seen a change in wording on a page here yesterday that leads me to believe that things ?might? be about to change for the better soon. I am waiting for a reply but likely wont hear anything until this coming week, and thats only if I read the item correctly and I am not just thinking wishfully.
